Ritwik Finance Enterprises Private Limited
Terms of Use
In short
Use Ritwik One honestly, for official trips only, and keep your sign-in to yourself. Claims are checked by people, and false claims are a disciplinary matter. The Platform records your location only during trips. If anything looks wrong, tell the Company.
1. Preamble
These Terms of Use (“Terms”) govern your use of Ritwik One on the web and on Android (the “Platform”), which Ritwik Finance Enterprises Private Limited (“the Company”, “we” or “us”) provides to its employees and contract staff (“you”). These Terms are part of the Company’s instructions to you.
These Terms apply alongside your appointment or engagement letter and the Company’s HR and travel reimbursement policies. If they conflict, the HR policy prevails. Nothing in these Terms takes away a right you have under law.
2. Who May Use the Platform
- Only employees and contract staff engaged by the Company who have been given an account by an administrator. There is no public sign-up.
- Your account is personal. Do not let anyone else use it, and do not use anyone else’s.
- Use the Platform only for the Company’s work.
3. Signing In
- You sign in with a one-time code sent to your registered email address. A code works once and expires after 10 minutes.
- Never share a code with anyone, including a manager or someone who says they are from the Company. The Company will never ask you for a code.
- If you sign in with a personal email address, anyone who can read that mailbox can sign in as you. Protect it with a strong password and two-step verification.
- Sessions end after 12 hours without use, and after 7 days at most. Sign out when you finish on a shared computer.
- Tell your manager and the tech team at once if you lose the phone you use for the Platform, think someone else has used your account, or get a code you did not ask for. Some cyber incidents must be reported to CERT-In within 6 hours, so a quick report matters.
- If your email address changes, ask HR to update your account. Do not ask for a second account.
4. Non-Acceptable Use
The following are not acceptable. You must not:
- record a trip, visit or expense that did not happen, or record the same one twice;
- use a trip for personal travel (short personal stops during a trip, such as a meal or fuel, are fine);
- use a mock-location app, a GPS-spoofing tool, a modified phone or any other way to change the location the Platform records;
- submit an edited, old, borrowed or downloaded photo, someone else’s photo, or a photo of a screen;
- get around approval limits, split a claim to stay under a limit, or approve your own claim;
- open, or try to open, data your role does not need, or copy or export Platform data except through a feature the Platform gives your role;
- screenshot customer or colleague data, or send Platform data through personal messaging apps, social media or personal email;
- reverse-engineer, modify or test the security of the Platform without the tech team’s written permission;
- upload anything unlawful, abusive, harmful or unrelated to work;
- use the Platform to track anyone other than yourself; or
- use the Platform while driving: stop safely first.
Any of these is a breach of these Terms (section 12). The Platform flags unusual patterns for a person to review, such as GPS distance that does not match the odometer, impossible speeds or a suspicious photo. A flag is not an accusation. You will be asked to explain before any action is taken.
5. Claims, Approvals and Payments
- Your entries are Company records: your approver relies on them and the Company pays from them. Before you submit, check that readings match the photos, amounts match the bills, and dates and places are right.
- Bills and tickets must clearly show the merchant or carrier, the date and the amount.
- The Platform calculates reimbursement from the policy in force when the trip started. Your approver can approve, send back, reject or part-approve expenses.
- Money is credited to your in-app wallet only on final approval, and paid to your bank account through payout requests.
- AI suggestions, such as the odometer reading, are advice only. You confirm or correct them, and a person approves every claim. No claim is rejected on an AI suggestion alone.
- If you find a mistake, tell your approver. Corrections are made through recorded adjustments, never by editing history.
6. Photos and Customer Data
- Take odometer and visit photos with the in-app camera, which stamps them with the time and location. Platform photos are Company records: do not keep copies on your phone or share them.
- Customer data is confidential. Record only what the screen asks for and the visit needs, and use it only for that visit. Do not write Aadhaar, PAN, bank account numbers or health details in remarks.
- Contact customers only from company numbers and channels, never from a personal number or messaging account.
- Your duty to keep customer data confidential continues after you leave the Company.
7. Monitoring and Privacy
The Platform is an employee-monitoring tool. It records your location only from Start trip until the trip ends, the photos you take, the customer details you enter, and every sign-in, approval and money change with the date, time, IP address and device. The Location Tracking Notice and the Privacy Policy explain what is recorded, why, who can see it and how long the Company keeps it.
8. Google Maps
The Platform includes Google Maps features and content. Use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. Do not hide or remove Google’s name, logo or copyright notices on maps.
9. Faults, Updates and Availability
- The Platform may sometimes be unavailable because of maintenance, network problems or faults, and features may change. If the Platform cannot be used, tell your manager and claim on a paper claim form, with odometer readings and bills.
- A software fault never reduces what you are owed under Company policy. If the Platform gets something wrong, the Company corrects it.
- Keep the app up to date. The Android app is updated only through Google Play.
- If you lose signal during a trip, GPS points are saved on your phone and uploaded later. Do not clear the app’s data or uninstall it during a trip.
10. Ownership
- The Platform, its software and design, and the Ritwik Finance name and logo belong to the Company or its licensors. You may use the Platform only for your work for the Company.
- Records you create on the Platform are Company records. This does not affect your rights over your own personal data.
- The Company may use ideas and feedback you send through the Platform without paying for them.
11. Suspension and Leaving
- Administrators disable your account when your employment or engagement ends. They may also suspend it while the Company investigates suspected misuse or a security incident. Either way, you are signed out everywhere at once.
- A suspension for investigation is not a finding of misconduct.
- Approved balances in your wallet remain payable under Company policy. Claims pending when you leave are handled under the Company’s travel reimbursement policy.
- Uninstall the app from any personal phone when you leave, after any trip has finished uploading.
12. Responsibility
- The Company is responsible for the Platform and for paying your correct entitlement.
- You are not personally liable for a loss caused by a fault in the Platform, or by acting in good faith under these Terms.
- False entries, misuse of the Platform and breaches of confidentiality may lead to disciplinary action and, where the law allows, legal action.
- The Company may recover an amount paid on a false or mistaken claim. Any recovery from your wages is made only as the Code on Wages, 2019 allows, within its limits.
- The Company is not responsible for loss of or damage to your personal phone, or for your mobile data costs.
13. Changes to these Terms
The Company may change these Terms, and will show a notice on the Platform before an important change takes effect. A change required by law or by a platform rule may take effect at once.
14. Governing Law and Courts
These Terms are governed by the laws of India. The courts at Jaipur, Rajasthan have exclusive jurisdiction over disputes about them. Nothing here stops you from using a forum the law gives you, including, for personal data, the Company’s Grievance Officer and then the Data Protection Board of India.
Contact and Grievances
For questions or complaints about these Terms or your personal data, contact the Company’s Grievance Officer. The Company replies within 30 days.
